This Privacy Policy explains how Lucy Jaynes LLC ("Lucy Jaynes", "we", "us", "our") collects, uses, discloses and protects personal information when you visit, interact with, or make a purchase from www.lucyjaynes.com (the "Site").

Notice at Collection

At or before the point we collect your personal information, this is what you should know:

  • We collect identifiers, customer records, commercial information, internet and device activity, approximate location, audio and visual information you choose to submit, account credentials, and inferences drawn from this data. The full list, with sources and purposes, is in the table below.
  • We use this information to fulfill your orders, provide support, secure the Site, comply with law, and market our products.
  • We share identifiers, internet activity, commercial information, approximate location and inferences with advertising and analytics partners for cross-context behavioral advertising. Under California and other state privacy laws, this may be considered a "sale" or "sharing" of personal information. You can opt out at any time: see Your Privacy Choices.
  • We do not knowingly sell or share the personal information of consumers under 16 years of age.
  • We retain each category of personal information for the periods described in "How Long We Keep Your Information" below.
  • We do not use or disclose sensitive personal information for purposes other than those permitted under California law, so we are not required to offer a "Limit the Use of My Sensitive Personal Information" option.

Information We Collect

The table below lists the categories of personal information we have collected in the preceding twelve (12) months, where it comes from, why we use it, who we disclose it to, and whether it is sold or shared.

We do not knowingly collect protected classification characteristics, biometric information, professional or employment information, education information, precise geolocation, health information, or genetic data.

How We Use Your Information

  • To process, fulfill, ship and track your orders, including returns, replacements and refunds
  • To communicate with you about your orders, account or support requests
  • To send marketing communications by email or text message, where you have consented
  • To administer our brand representative and wholesale programs
  • To operate, secure, debug and improve our website and services
  • To measure, target and improve our advertising

  • To comply with legal, tax and accounting obligations and to establish, exercise or defend legal claims

Cookies, Pixels and Advertising Technologies

We use cookies, pixels, tags, SDKs and similar technologies to operate the Site, remember your cart, analyze traffic, and deliver and measure advertising. These include tools provided by Shopify, Meta (Facebook and Instagram), Google, Klaviyo, Postscript and similar services. Information collected may include your IP address, device and browser characteristics, pages viewed, time on site, purchases, and interactions with our ads.

You can manage cookies through your browser settings. Blocking some cookies may affect how the Site works.

Global Privacy Control. We honor the Global Privacy Control ("GPC") opt-out preference signal. If you visit the Site with GPC enabled, we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising for the browser and device you are using. Because GPC applies at the browser and device level, you will need to enable it on each browser and device you use.

Do Not Track. Some browsers offer a "Do Not Track" ("DNT") setting. There is no consistent industry standard for how to respond to DNT signals, and we do not currently respond to them. We do respond to GPC as described above.

How We Disclose Your Information

  • E-commerce and hosting platform: Shopify Inc., which provides the platform, checkout and data storage for our store
  • Payment processors: including Shopify Payments, Shop Pay, PayPal and similar providers. We do not store your full payment card number. Card data is handled by these providers in compliance with PCI-DSS.
  • Order routing and print fulfillment providers: our production partners who print, pack and ship your order
  • Shipping carriers: including USPS, UPS, FedEx, DHL, and Asendia for international shipments
  • Email and SMS marketing platforms: including Klaviyo and Postscript
  • Advertising and analytics platforms: including Meta and Google
  • Customer support platform used to receive and respond to your messages
  • Product review platform: Loox, described below
  • Promotion and cashback providers, including Fondue, where you participate in such an offer
  • Professional advisors: accountants, auditors, insurers and attorneys
  • Law enforcement, regulators and courts, where required by law, subpoena or legal process, or to protect our rights, property or safety or that of others
  • An acquirer, in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business

We do not disclose your personal information to third parties for those third parties' own independent direct marketing purposes. California residents may request information about such disclosures under Cal. Civ. Code §1798.83 by contacting us as described below.

Customer Reviews (Loox)

We use Loox, a third party service, to collect and display product reviews. When you submit a review, your first name, review content, star rating and any photos you choose to upload may be published on our website and visible to other customers. Loox processes this data in accordance with its own privacy policy.

By submitting a photo with your review, you grant Lucy Jaynes the right to use that photo, along with your review content, for marketing purposes including email campaigns, social media posts and advertising. If you do not want your photo used this way, do not upload it, or contact us to request removal. Where we offer any incentive for submitting a review, that incentive is disclosed at the time of the request and alongside the published review, and is never conditioned on the rating or content of your review. We do not suppress, delay or remove reviews because they are negative.

Brand Representative Program

If you apply to or participate in our brand representative program, we collect your name, email address, shipping address, social media handle and the content you create. We use this to evaluate your application, send you product, track participation, and reproduce your content in our marketing as described in our Terms of Service. If you leave the program, contact us and we will stop using new content, although content already published in past campaigns may remain.

Notice of Financial Incentive

We offer a discount in exchange for signing up for our email list, our text message program, or both. Because this program involves the collection of personal information, it is a "financial incentive" under California law. Here are the material terms:

  • What we collect: your email address, and, if you opt into text messages, your mobile phone number. We also associate your subsequent browsing and purchase activity with your subscriber profile.
  • What you receive: a one-time welcome offer on your first qualifying order, subject to the terms shown at signup, plus ongoing marketing messages. The welcome offer is currently 15% off. From time to time we test alternative offers of comparable value, such as a cashback reward issued after your purchase is completed and verified. The exact offer is always displayed at signup before you provide your information. Subscribers may also receive access to promotional offers from time to time. Those offers vary in value, are not guaranteed, and are frequently made available to non-subscribers as well.
  • How to opt in: submit your email address or phone number through our signup form and confirm as prompted.
  • How to withdraw: unsubscribe at any time using the link in any marketing email, by replying STOP to any text message, or by emailing us. Withdrawing may end your eligibility for a discount that has not yet been used.
  • Estimated value of your data and how we calculated it: we estimate the value of the personal information collected under this program to be approximately $10 per subscriber. We calculated this using the expense we incur in providing the incentive, specifically the current 15% welcome offer applied to our average order value of $63.74 measured over the trailing 90 days. Where we test an alternative offer, we use the same method and the resulting value is comparable. This is a conservative estimate, because not every subscriber redeems the offer. We do not assign a separate monetary value to your personal information outside of this program.
  • Why the incentive is permitted: the difference in price is reasonably related to the value the data provides to us, as calculated above.

How Long We Keep Your Information

Where we are required to keep information longer to comply with law, resolve disputes, or enforce our agreements, we will retain it for that longer period.

Security

We take reasonable precautions and follow industry practices to protect personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction. Our store operates over TLS encryption, and payment card data is handled by PCI-DSS compliant payment processors. We do not store full payment card numbers on our systems. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

If we become aware of a security incident affecting your personal information, we will notify you and any applicable regulator as required by law. To report a security concern, email store@lucyjaynes.com with "Security" in the subject line.

Your Privacy Rights

California residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclose it
  • Access a copy of your personal information in a portable format
  • Delete personal information we have collected from you, subject to legal exceptions
  • Correct inaccurate personal information
  • Opt out of the sale or sharing of your personal information, including for cross-context behavioral advertising
  • Limit the use of sensitive personal information. We do not use or disclose sensitive personal information for purposes that trigger this right, so no separate link is provided.
  • Not be discriminated against for exercising any of these rights. We will not deny you goods or services, charge you a different price, or provide a different level of quality because you exercised a privacy right, other than through the lawful financial incentive program disclosed above.

Residents of other US states

If you live in a state with a comprehensive consumer privacy law (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island and others as those laws take effect), you have similar rights to access, correct, delete, obtain a portable copy of your personal information, and opt out of targeted advertising, sale, and certain profiling. Where your state provides a right to appeal a denial, you may appeal by replying to our decision or emailing us with "Privacy Appeal" in the subject line. We will respond to an appeal within 45 days (60 days in Colorado, or as otherwise required). We recognize universal opt-out mechanisms, including Global Privacy Control, as valid opt-out requests where required by your state's law.

How to submit a request

You may submit a request using either of these methods:

  1. Email store@lucyjaynes.com with "Privacy Request" in the subject line, or
  2. Use our contact form and state that your message is a privacy request.

To opt out of the sale or sharing of your personal information for advertising, visit Your Privacy Choices or enable Global Privacy Control in your browser.

Verification. To protect your information, we will verify your identity before fulfilling a request to know, delete or correct. We typically do this by asking you to confirm information already in our records, such as the email address used to place an order and details of a recent order. We will not ask for a government identification document unless we cannot otherwise verify you. If we cannot verify your identity, we will not be able to fulfill the request, and we will tell you why.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. The agent must provide written permission signed by you, and we may still contact you directly to confirm the request and verify your identity.

Timing. We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need more time, we will tell you and may extend by an additional 45 days. Opt-out requests are processed within 15 business days. There is no charge unless a request is manifestly unfounded or excessive.

Visitors outside the United States

Lucy Jaynes is a United States business. We ship to the United States and to a limited number of other destinations shown at checkout. We do not offer goods or services to, market to, or ship to residents of the European Economic Area, the United Kingdom or Switzerland.

If you access the Site from outside the United States, you do so on your own initiative, and any personal information you provide will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your country. If you are a resident of the EEA, the UK or Switzerland and believe we hold personal information about you, you may contact us at store@lucyjaynes.com and we will honor reasonable requests to access or delete it.

Children's Privacy

Our Site and products are intended for adults. We do not knowingly collect personal information from children under 13 years of age, and we do not knowingly sell or share the personal information of consumers we know to be under 16. If you believe a child has provided us with personal information, contact store@lucyjaynes.com and we will delete it promptly.

Third Party Sites

When you click a link that takes you off our Site, you are no longer governed by this Privacy Policy or our Terms of Service. We are not responsible for the privacy practices of other sites and encourage you to read their privacy notices.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above. If we make material changes, we will provide additional notice, such as by email or a notice on the Site, before the changes take effect where required by law.

If our business is acquired or merged with another company, your information may be transferred to the new owners so that they may continue to provide products and services to you, subject to this Policy.
